LIABILITY RELEASE

As a legal guardian or parent of the student registration, and me and my student being permitted to participate in The Happening Dance Company (The Happening) programs and activities, appreciating any possible dangers, hazards, or injuries inherent in The Happening programs, activities and transportation between the Studios and to/from different events which are part of The Happening programs, hereby assumes the risks and responsibilities surrounding my or my child’s participation in the foregoing programs, activities, transportation or other activities, including but not limited to the online training and events, as an adjunct hereto; and further, I, for myself, my heirs, and personal representative(s) hereby defend, hold harmless, indemnify, release and forever discharge The Happening and all its owners, agents, employees and any other staff members from and against any and all claims, demands and actions or causes of actions on account of damage to property or personal injury, which may result in my or my child’s participation in such programs, activities and transportation during and outside the The Happening Classes and on or outside The Happening premises, including but not limited to the online classes and other events.

Furthermore, I/we agree to obey The Happening Studios and facility rules, as well as any rule that may apply to participating in The Happening programs, both on and outsideThe Happening premises, included but not limited to the online programs offered by The Happening, and take full responsibility for any damage I/we may cause to the Studios and facilities in use during participating to The Happening programs. In the event that I/we should observe any unsafe personal conduct or unsafe physical condition during the Classes, I/we agree to report the unsafe conduct or condition to a staff member as soon as possible.

I/we represent to The Happening that the participant is physically capable of participating in the vigorous cardiovascular exercise program and that, to the extent necessary in light of prior health history, weight and physical condition, I have consulted a personal physician or other health authority before making such representation. I recognize the risk of illness and injury inherent in any dance or exercise program and I am allowing the participant to take part in The Happening Dance Company's program upon the express agreement and understanding that I am hereby waiving and releasing The Happening before participating in any of its programs of any change in the participant's physical condition which might in any way adversely affect their ability to participate in the program safely.

I/we further understand and agree that I/we give this release freely, voluntarily, and in the consideration of me or my child being granted permission to participate in The Happening programs and activities, including but not limited to the online classes and training. I/we also agree that these Terms and Conditions and Release and Liability Waiver shall be effective whether or nor I/we have in force any policy of insurance to cover me or my child for injuries which may arise from participation in The Happening programs, activities and transportation, including but not limited to the online classes and training. If I/we do not have any such policy in effect, then I/we personally assume and agree to pay for the loss or damage occasioned from said activities during the period of my or my child’s participation, and I/we expressly agree not to look to The Happening for reimbursement for any such loss or damage. I/we do agree that The Happening can obtain the medical care for my child that the staff deems suitable, should it prove to be necessary.

MEDIA RELEASE

As a legal guardian or parent of the student registrant, I consent to the use of the registered student's photograph(s) and video (that may include them) for advertising, promotions or instructional purposes of The Happening Dance. Such material includes but is not limited to: social media, in-studio advertising, newspapers, television, web design, advertisement and columns, and training videos. I understand that all digital media attained will not be reproduced or sold in whole or part for any purposes other than stated above.

Registrants also consent for The Happening Dance Company to sign media release forms on their behalf for events in which the registrant is a participant, including but not limited to dance performances, competitions, and/or workshops/camps.

PRIVACY

The Happening gathers and maintains personal information for the purposes of program registration and communication about The Happening activities. Activities you may be advised of include programs, services, special events, open houses, exhibits, performances, and/or fundraising initiatives. The Happening respects your privacy and will not disclose your information without your consent.
